Welcome to America 250. These Terms of Service ("Terms") govern your access to and use of the website america250.live and any related services (collectively, the "Service") operated by CASIR AGENCY S.R.L., a limited liability company registered ("we," "us," or "our").

Please read these Terms carefully. By accessing or using the Service, and especially before making any purchase, you agree to be bound by them. If you do not agree, do not use the Service.

#1. Eligibility

You must be at least 16 years old to create an account or use the Service. To make a purchase on the Service, you must additionally be of the age of majority in your jurisdiction (typically 18) or have the consent and involvement of a parent or legal guardian. By using the Service, you represent and warrant that:

You meet the applicable age requirements.
You have the legal capacity to enter into a binding contract.
You are not barred from using the Service under applicable law.
The information you provide is accurate and current.

#2. The Service

America 250 is a commemorative digital experience honoring the 250th anniversary of the United States of America. The Service allows registered users to purchase and personalize Hexes — individual hexagonal spaces on an interactive map — and to publish stories, inscriptions, and other content associated with them.

#2.1 Independent, Non-Governmental Project

America 250 is an independent, privately operated commemorative project. It is not affiliated with, endorsed by, sponsored by, or in any way connected to:

The United States Government or any of its agencies, departments, or branches (federal, state, or local).
The U.S. Semiquincentennial Commission ("America250"), america250.org, or any other official, governmental, or congressionally-chartered 250th anniversary commission, organization, or initiative.
Any state-level 250th anniversary commission or related governmental body.

All views, content, and historical material presented on the Service are those of CASÎR AGENCY S.R.L. and individual users, and do not represent the views or positions of any government or official commemorative body. The name "America 250" as used on this Service refers solely to this independent commemorative experience and should not be confused with any governmental initiative of similar name.

#3. Your Account

To use certain features, including purchasing a Hex, you must create an account. You agree to:

Provide accurate, complete, and up-to-date information.
Keep your password confidential and secure.
Notify us immediately at [email protected] of any unauthorized use of your account.
Be responsible for all activity that occurs under your account.

You may not create more than one account, share your account, or transfer your account to another person without our prior written consent. We may suspend or terminate accounts that violate these Terms.

#4. Purchase of Hexes

#4.1 What You Are Purchasing

When you purchase a Hex, you acquire a personal, non-exclusive, non-transferable license that includes:

Hex coordinate assignment — one specific hexagonal coordinate on the America 250 map permanently associated with your account.
Story publication rights — the ability to publish and display content of your choice on that Hex, subject to these Terms and our content rules (Section 6), with the story made publicly viewable as part of the commemorative record.
Digital commemorative certificate — an individual digital certificate confirming your acquisition of the Hex, displaying your name (or chosen display identifier), the Hex coordinates, the purchase date, and a QR code linking to the public page of your Hex and its associated story. The certificate is delivered electronically (e.g., as a downloadable PDF or image) after purchase completion and is intended for personal, commemorative use only.

A Hex and its associated certificate are digital items existing within the Service. They are not real property, not securities, not financial instruments, and confer no rights outside the Service.

#4.2 Hex Types and Pricing

We currently offer:

Standard Hex — USD $99 (one-time payment)
Featured Hex — USD $149 (one-time payment) — receives enhanced visibility and prominence on the Service as described on the purchase page at the time of purchase

All prices are stated in U.S. dollars (USD) and are exclusive of any applicable taxes, which may be added at checkout based on your jurisdiction.

Pricing may change at any time. Any new price applies only to purchases made after the change takes effect; it does not affect Hexes already purchased.

#4.3 Payment

Payments are processed exclusively by PayPal under PayPal's own terms and privacy policy. We do not collect or store your credit card or bank account details.

By completing a purchase, you authorize us (through PayPal) to charge the full purchase price, plus any applicable taxes, to your selected payment method.

#4.4 Duration

Subject to these Terms, your Hex license remains in effect for as long as the Service is operational and your account is in good standing. We intend to operate the Service indefinitely as a commemorative experience, but we cannot and do not guarantee perpetual availability. See Section 4.9 (Service Discontinuation) below.

#4.5 Non-Transferability

Hexes are personal to your account and may not be sold, gifted, traded, assigned, or otherwise transferred to any other person or account. Any attempted transfer is void. Hexes do not pass by inheritance, succession, or operation of law.

#4.6 All Sales Are Final — No Refunds

Except where required by applicable mandatory consumer protection law (see Section 4.7 below), all sales are final. We do not offer refunds, partial or full, including but not limited to:

Change of mind.
Failure to use or engage with your Hex.
Removal of your content for violation of these Terms.
Suspension or termination of your account due to your violation of these Terms.
Subsequent price reductions or promotional offers.
Discontinuation of the Service after a reasonable operating period.

#4.7 EU/EEA/UK Consumer Right of Withdrawal

If you are a consumer residing in the European Union, the European Economic Area, or the United Kingdom, you generally have a right to withdraw from a distance contract within 14 days of conclusion, without giving any reason, under EU Directive 2011/83/EU and equivalent national laws.

Important — Express Waiver of the Right of Withdrawal:

Because a Hex is digital content that is supplied to you immediately upon completion of the purchase, the right of withdrawal does not apply if you, at the time of purchase:

Give your express prior consent to begin the supply of the digital content before the end of the 14-day withdrawal period, and
Acknowledge that you thereby lose your right of withdrawal.

At checkout, you will be asked to confirm this consent and acknowledgment. By completing the purchase, you confirm both. If you do not wish to waive your right of withdrawal, do not complete the purchase.

If, for any reason, you have not provided this express waiver, you may exercise your right of withdrawal within 14 days by emailing [email protected] with your name, the email associated with the purchase, and the transaction ID. We will refund the purchase price within 14 days of receiving your withdrawal notice, using the same payment method.

#4.8 Chargebacks and PayPal Buyer Protection

You may have additional rights under PayPal's Buyer Protection program. We reserve the right to suspend or terminate the account of any user who initiates an unjustified chargeback or PayPal dispute in bad faith.

#4.9 Service Discontinuation

If we decide to discontinue the Service, we will use reasonable efforts to provide affected users with at least 90 days' advance notice by email and through the Service. During that period, you will be given a reasonable opportunity to export your content. No refund is owed in connection with discontinuation, except as may be required by applicable mandatory consumer protection law.

#4.10 Taxes

Prices displayed on the Service are exclusive of any taxes, duties, or government fees that may apply to your purchase based on your jurisdiction (including U.S. state sales tax, EU VAT, or other applicable taxes). Where we are required by law to collect such taxes, they will be added at checkout. Where collection is not our responsibility, you are responsible for any self-assessment or reporting required under your local law.

#4.11 Nature of the Purchase — Digital and Commemorative Only

You acknowledge and agree that:

All items sold on the Service are purely digital — digital map coordinates, digital display rights, and digital commemorative certificates. No physical goods, land, real estate, deeds, or tangible property of any kind are sold, transferred, or implied.
The Hex does not represent any ownership of, claim to, interest in, or right over any real-world land, territory, geographic location, real property, or natural resource. The map is a stylized digital representation for commemorative purposes only.
The purchase is not an investment. It is not a financial product, a security, a token, a cryptocurrency, a share, a unit of any fund, or any form of investment contract. You should not expect any financial return, profit, dividend, appreciation in value, resale market, or monetary benefit from your purchase.
The purchase is commemorative in nature — its value is personal, symbolic, and experiential. You are paying to participate in a commemorative digital experience and to publish your story as part of it.
No tax-deductibility, charitable status, or governmental recognition is conferred by, or associated with, the purchase. CASÎR AGENCY S.R.L. is a commercial company, not a charity, foundation, or governmental entity.

#5. User-Generated Content

#5.1 Your Content

You retain ownership of any text, images, or other material you submit, publish, or display on the Service ("Your Content"). You alone are responsible for Your Content and the consequences of publishing it.

#5.2 License You Grant Us

By submitting Your Content, you grant CASÎR AGENCY S.R.L. a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for technical purposes such as formatting), publicly display, publicly perform, distribute, and otherwise use Your Content in connection with operating, providing, and promoting the Service.

This license continues even if you close your account or your Hex is removed, with respect to copies of Your Content that have been incorporated into the historical record of the Service or that other users have engaged with, except where you exercise a legal right to require removal.

#5.3 Representations and Warranties

By submitting Your Content, you represent and warrant that:

You own Your Content or have all necessary rights, licenses, and permissions to submit it and to grant the license above.
Your Content does not infringe any third party's intellectual property, privacy, publicity, or other rights.
Your Content complies with these Terms and all applicable laws.

#6. Content Rules

You may not submit content that:

Is unlawful, defamatory, fraudulent, threatening, harassing, abusive, hateful, or discriminatory.
Incites violence or promotes terrorism.
Sexually exploits or harms minors, or depicts minors in a sexual manner.
Contains pornography or sexually explicit material.
Infringes any patent, trademark, trade secret, copyright, right of publicity, or other right of any party.
Contains malware, viruses, or other harmful code.
Impersonates any person or entity, or misrepresents your affiliation with any person or entity.
Contains spam, advertising, or unsolicited commercial communications unrelated to the commemorative purpose of the Service.
Discloses another person's private information without authorization.
Falsifies historical facts in a manner designed to mislead other users about events, persons, or places of public significance.

#6.1 Moderation

We have the right, but not the obligation, to monitor, review, edit, remove, or refuse to publish any content for any reason, including suspected violation of these Terms. We are not responsible for content posted by users and do not endorse it.

If we remove your content for violation of these Terms, you remain the holder of the Hex coordinate associated with your account, but you are not entitled to a refund. We may, in our discretion, allow you to submit replacement content that complies with these Terms.

In cases of serious or repeated violations, we may terminate your account and permanently remove your content. No refund is owed in such circumstances.

#7. Acceptable Use

You agree not to:

Use the Service in any way that violates any applicable law or regulation.
Use the Service to transmit unsolicited advertising, spam, chain letters, or pyramid schemes.
Attempt to gain unauthorized access to the Service, other users' accounts, or our systems.
Probe, scan, or test the vulnerability of the Service except through a responsible disclosure to us.
Interfere with or disrupt the Service, the servers, or networks connected to it.
Use bots, scrapers, or automated means to access the Service except for publicly accessible content via robots.txt-respecting crawlers.
Reverse engineer, decompile, or disassemble any part of the Service.
Impersonate any person or misrepresent your identity or affiliation.
Resell, sublicense, or commercially exploit any part of the Service (including your Hex) without our prior written consent.

#8. Intellectual Property

Excluding Your Content, the Service and all content, features, and functionality on it — including the design, code, logos, graphics, text, and the curated historical material we publish — are owned by CASÎR AGENCY S.R.L. or our licensors and are protected by copyright, trademark, and other intellectual property laws.

"America 250" and associated logos are marks of CASÎR AGENCY S.R.L. You may not use them without our prior written permission.

You may view and use the Service for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, or create derivative works of any part of the Service (other than Your Content) without our prior written consent.

#9. Copyright Infringement (DMCA Notice and Takedown)

We respect intellectual property rights. If you believe content on the Service infringes your copyright, you may send a notice that complies with the Digital Millennium Copyright Act, 17 U.S.C. § 512(c) to our designated agent:

Your notice must include:

A physical or electronic signature of the copyright owner or person authorized to act on their behalf.
Identification of the copyrighted work claimed to have been infringed.
Identification of the material claimed to be infringing, with sufficient detail to allow us to locate it (e.g., URL).
Your contact information (address, telephone, email).
A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

We may remove allegedly infringing content and, in appropriate circumstances, terminate accounts of repeat infringers.

If you believe content of yours was removed in error, you may submit a counter-notice to the same address.

#10. Termination

You may close your account at any time by contacting [email protected]. Closing your account does not entitle you to a refund of any purchase.

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or that your use poses a risk to the Service, to us, or to other users. Termination for cause does not entitle you to a refund.

Upon termination, the rights and licenses granted to you under these Terms will end, but provisions that by their nature should survive (including Sections 4.6, 4.10, 5.2, 8, 11, 12, 13, and 14) will continue to apply.

#11. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that:

The Service will be uninterrupted, secure, or error-free.
Any content on the Service, including user-submitted stories and historical material, is accurate, complete, or reliable.
Defects in the Service will be corrected.
The Service will remain available indefinitely.

Historical content displayed on the Service is provided for commemorative and educational purposes. We make reasonable efforts toward accuracy but make no guarantees and the Service is not a substitute for authoritative historical or scholarly sources.

Nothing in these Terms limits any warranty or consumer right that cannot be excluded under applicable law. Consumers in the European Union and other jurisdictions retain their statutory rights.

#12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will CASÎR AGENCY S.R.L., its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from or in connection with your use of the Service.

Our aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the total amount you paid us for the specific Hex or purchase giving rise to the claim.

These limitations do not apply to liability that cannot be excluded or limited under applicable mandatory law (including, for consumers in the EU, liability for gross negligence, willful misconduct, or death or personal injury caused by our negligence).

#13. Indemnification

You agree to indemnify, defend, and hold harmless CASÎR AGENCY S.R.L. and its directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party right, including any intellectual property or privacy right.

#14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Moldova, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to the competent courts of the Republic of Moldova at the registered office of CASÎR AGENCY S.R.L.

Consumers residing in the European Union, the United Kingdom, or another jurisdiction that grants you the right to bring proceedings in your country of residence retain that right. Nothing in this Section limits mandatory consumer protections available to you under the law of your country of residence.

EU consumers may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

#15. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on the Service with an updated "Last Updated" date. Material changes will be communicated through the Service or by email to your account address at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Changes to these Terms do not retroactively affect the pricing, license type, or non-refundability of Hexes already purchased before the effective date of the change.

#16. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
Severability. If any provision is held unenforceable, the remaining provisions will continue in full force.
No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Language. These Terms are written in English. Any translation is provided for convenience only; the English version controls.
